Art. 1. General information

The confidentiality of your personal data is one of the main concerns of HOSTIFY 24 SRL, as data controller.

This document is meant to inform you about the processing of your personal data, in the context of using the website www.chlink.ro (the "Site").

Art. 2. Categories of personal data processed

2.1. If you are a customer of the Site, HOSTIFY 24 SRL will process your personal data, such as first and last name, phone number, email address, billing address, delivery address, data related to how you use the Site, for example your behavior/preferences/habits with HOSTIFY 24 SRL, as well as any other categories of data you provide directly in the context of creating a user account, placing an order through the site, or in any other way resulting from your use of the Site.

2.2. If you use your Facebook or Google account to create a user account on the Site, HOSTIFY 24 SRL will process the following public profile data displayed by those applications: username, email address.

2.3. If you choose to create a user account only right before completing an order for a product available on the Site, your email address will be requested, and an account will be automatically created based on it. If you do not complete the order, the email address and other data provided will not be stored by HOSTIFY 24 SRL, and the account created will be automatically deleted.

2.4. If you are a visitor of the Site, HOSTIFY 24 SRL will process the personal data you provide directly in the context of using the Site, such as the data you provide in the contact / questions / complaints section, to the extent that you contact us this way.

Art. 3. Purposes and legal grounds for processing

3.1. If you are a customer of the Site, HOSTIFY 24 SRL processes your personal data as follows:

  • to carry out the contractual relationship between you and HOSTIFY 24 SRL, namely to receive, validate, ship and invoice orders placed on the Site, inform you about your order status, organize the return of ordered products, etc. Legal ground: Processing your data for this purpose is based on the contract concluded between you and HOSTIFY 24 SRL, as defined in the Terms and Conditions. Providing your personal data is necessary for the performance of this contract. Refusing to provide the data may result in the impossibility of carrying out the contractual relationship between you and HOSTIFY 24 SRL.
  • to fulfil the legal obligations HOSTIFY 24 SRL has in the context of the services provided through the Site, including tax and archiving obligations. Legal ground: Processing your data for this purpose is required under legal obligations. Providing your data for this purpose is required. Refusing to provide the data may result in HOSTIFY 24 SRL being unable to comply with its legal obligations, and therefore unable to offer you the services through the Site.
  • for marketing activities, namely sending, through distance-communication means (email, SMS), commercial communications about the products and services offered by HOSTIFY 24 SRL through the Site. Legal ground: Processing your data for this purpose is based on your consent, if you choose to provide it. You can express your consent for processing data for this purpose by checking the corresponding box when creating your account, or afterwards, in the My Account Information section. To unsubscribe from receiving such commercial communications, you can use the option at the end of every email/SMS containing commercial communications. In addition, you can unsubscribe by accessing the My Account Information section. Providing your data for this purpose is voluntary. Refusing to give consent for processing your data for this purpose will have no negative consequences for you.
  • for the purpose of carrying out various analyses and reports on how the Site works, and building consumption-preference profiles, mainly in order to improve the experience offered on the Site. Legal ground: Processing your data for this purpose is based on HOSTIFY 24 SRL's legitimate interest in continuously improving the customer experience on the Site. Providing your data for this purpose is voluntary. Refusing to provide the data for this purpose will have no negative consequences for you. 3.2. If you are a visitor of the Site, HOSTIFY 24 SRL processes your personal data as follows:
  • for marketing activities, namely sending, through distance-communication means (email, SMS), commercial communications about the products and services offered by HOSTIFY 24 SRL through the Site. Legal ground: Processing your data for this purpose is based on your consent, if you choose to provide it. You can express your consent for processing data for this purpose by filling in and checking the corresponding box in the newsletter subscription form available on the Site. To unsubscribe from receiving such commercial communications, you can use the option at the end of every email/SMS containing commercial communications. Providing your data for this purpose is voluntary. Refusing to give consent for processing your data for this purpose will have no negative consequences for you.
  • to resolve complaints, grievances, and to monitor traffic and improve the experience offered to you on the Site. Legal ground: Processing your data for this purpose is based on HOSTIFY 24 SRL's legitimate interest in ensuring the Site functions correctly, as well as continuously improving the experience of Site visitors, including by resolving various comments, questions or complaints. Providing your data for this purpose is voluntary. Refusing to provide the data for this purpose will have no negative consequences for you.

Art. 4. Duration for which we process your data

4.1. As a principle, HOSTIFY 24 SRL will process your personal data for as long as necessary to achieve the processing purposes mentioned above.

If you are a customer, we will process your data for the entire duration of the contractual relationship and afterwards according to the legal obligations HOSTIFY 24 SRL has (e.g., for financial-accounting supporting documents, for which the legal retention period is 10 years from the end of the financial year in which they were prepared).

4.2. If you are a customer and exercise the option to delete your user account, by pressing the Delete Account button in the My Account Information section, HOSTIFY 24 SRL will interpret this action as your choice to unsubscribe from receiving commercial communications keeping you updated on the products and services offered through the site. Accordingly, if you choose to delete your user account, we will no longer send you emails and/or SMS messages of this kind. However, we want to inform you that deleting the account will not automatically result in the deletion of your personal data. If you no longer want your personal data to be processed, or if you want your data deleted, you can exercise the rights detailed in point VII below. If you request account deletion but there is at least one active order on that account, the account deletion request can only be recorded after the products are delivered and the last active order is completed.

If you withdraw your consent for processing data for marketing purposes, HOSTIFY 24 SRL will stop processing your personal data for this purpose, without affecting the processing carried out by HOSTIFY 24 SRL based on the consent you expressed before withdrawing it.

Art. 5. Disclosure of personal data

To fulfil the processing purposes, HOSTIFY 24 SRL may disclose your data to partners, to third parties or entities that support HOSTIFY 24 SRL in carrying out its activity through the Site (for example courier companies, IT service providers), or to central/local public authorities, in the following non-exhaustive cases:

  • for administering the Site;
  • in situations where such disclosure would be necessary to award prizes or other benefits to data subjects, obtained as a result of their participation in various promotional campaigns organized by HOSTIFY 24 SRL through the Site;
  • for maintaining, customizing and improving the Site and the services carried out through it;
  • for performing data analysis, testing and research, monitoring usage and activity trends, developing safety features and authenticating users;
  • for sending marketing commercial communications, under the conditions and limits provided by law;
  • whenever disclosure of personal data is required by law, etc.

Art. 6. Transfer of personal data

Personal data provided to HOSTIFY 24 SRL may be transferred outside Romania, but only to European Union member states.

Art. 7. Your rights

7.1. Under the conditions set out by personal data processing legislation, as a data subject, you benefit from the following rights:

  • the right to be informed, namely the right to receive details about the processing activities carried out by HOSTIFY 24 SRL, as described in this document;
  • the right of access to data, namely the right to obtain confirmation from HOSTIFY 24 SRL regarding the processing of personal data, as well as details about the processing activities such as how the data is processed, the purpose of processing, the recipients or categories of recipients of the data, etc;
  • the right to rectification, namely the right to obtain, without undue delay, the correction by HOSTIFY 24 SRL of inaccurate/unjustified personal data, as well as the completion of incomplete data; The rectification/completion will be communicated to each recipient to whom the data was transmitted, unless this proves impossible or involves disproportionate effort.

the right to erasure of data, without undue delay (the right to be forgotten), if one of the following reasons applies:

  • they are no longer necessary for the purposes for which they were collected or processed;
  • if consent is withdrawn and there is no other legal ground for processing;
  • if the data subject objects to processing and there are no overriding legitimate grounds;
  • if the personal data has been processed unlawfully;
  • if the personal data must be erased to comply with a legal obligation;
  • the personal data was collected in relation to the offer of information society services under Union or national law applicable to the controller.

7.2. Following a data-erasure request, HOSTIFY 24 SRL may anonymize this data (thus stripping it of its personal character) and continue processing it under these conditions for statistical purposes.

the right to restriction of processing, to the extent that:

  • the data subject contests the accuracy of the data, for a period allowing us to verify the accuracy of the data;
  • the processing is unlawful and the data subject opposes the erasure of the personal data, requesting instead the restriction of its use;
  • the controller no longer needs the personal data for processing purposes, but the data subject requests it for the establishment, exercise or defense of a legal claim; or
  • the data subject has objected to processing (other than for direct marketing), for the period during which it is verified whether the controller's legitimate grounds override those of the data subject.
  • the right to data portability, namely (i) the right to receive the personal data in a structured, commonly used and machine-readable format, as well as (ii) the right to have this data transmitted by HOSTIFY 24 SRL to another data controller, to the extent the conditions provided by law are met;

the right to object — regarding the processing activities, this can be exercised by sending a request as indicated below:

  • at any time, for reasons related to the data subject's particular situation, that their data be processed based on HOSTIFY 24 SRL's legitimate interest or public interest, except where HOSTIFY 24 SRL can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or that the purpose is the establishment, exercise or defense of a legal claim;
  • at any time, free of charge and without any justification, that their data be processed for direct marketing purposes.
  • the right not to be subject to an automated individual decision, namely the right not to be subject to a decision based solely on automated processing activities, including profiling, which produces legal effects concerning the data subject or similarly significantly affects them;
  • the right to lodge a complaint with the National Supervisory Authority for Personal Data Processing or with the competent courts, to the extent you consider necessary.
